1. Acceptance of Terms

By accessing, browsing, registering on, or using DrSetu (the "Platform", available at drsetu.in and related apps), you ("you", "User") agree to be bound by these Terms & Conditions, our Privacy Policy, and any additional guidelines or policies published on the Platform (together, the "Terms"). If you do not agree, you must not use the Platform.

If you use the Platform on behalf of a chamber, clinic, hospital or other entity, you represent that you are authorised to bind that entity to these Terms.

2. Definitions

• "Company", "we", "us", "our" means MediSetu Technologies, the operator of the Platform.
• "Patient" means a User who searches for doctors and books appointments.
• "Doctor" means an independent medical practitioner listed on the Platform.
• "Chamber" means a clinic, hospital, diagnostic centre or other healthcare facility registered on the Platform.
• "Provider" means, collectively, Doctors and Chambers.
• "Booking Fee" / "Platform Charge" means the online convenience/technology fee charged by the Platform for facilitating a booking, separate from the Provider's consultation fee.
• "Consultation Fee" means the professional fee charged by a Doctor/Chamber, payable at the chamber.

3. Nature of the Platform

The Platform is an "intermediary" within the meaning of the Information Technology Act, 2000, and merely provides a technology venue to discover Providers and to book appointments and generate digital tokens. We are a facilitator only.

We do not: (a) provide medical, diagnostic, or treatment services; (b) recommend or endorse any particular Doctor or Chamber; (c) verify the outcome, quality, or appropriateness of any consultation or treatment; or (d) act as an agent of any Patient or Provider. The doctor–patient relationship is solely between the Patient and the Provider. We are not a party to it and bear no responsibility for it.

Listings, availability, fees, timings, qualifications and other information are supplied by Providers. While we take reasonable steps to verify Providers, we do not guarantee the accuracy, completeness or currency of such information.

4. Eligibility & Accounts

You must be at least 18 years old (or accessing on behalf of a minor as their parent/legal guardian) and legally capable of entering into a binding contract under the Indian Contract Act, 1872. You agree to provide accurate, current and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may refuse, suspend, or terminate accounts at our discretion.

5. Party-Specific Terms

The following terms apply to you based on how you use the Platform. General Terms in the rest of this document apply to all Users.

6. Bookings, Tokens & Appointments

A confirmed booking reserves a slot subject to the Provider's schedule. Estimated times are indicative and may change due to emergencies, delays or operational reasons. Providers may reschedule or decline appointments. We are not liable for delays, changes, or the Provider's failure to honour a booking, though we will make reasonable efforts to assist.

7. Fees, Charges & Payments

The Platform may charge a Booking Fee/Platform Charge for facilitating an online booking. This is displayed before you confirm and is distinct from the Consultation Fee. Online payments are processed by third-party payment gateways; we do not store full card details. Consultation Fees are collected by the Provider at the chamber. All fees are exclusive of applicable taxes unless stated otherwise.

8. Cancellations, No-shows & Refunds

Patients may cancel eligible appointments through the Platform where permitted. Booking Fees/Platform Charges are generally non-refundable as they cover the cost of facilitating the booking, except where required by law or expressly stated in a published refund policy. Refunds of Consultation Fees, where applicable, are handled by the Provider. Repeated no-shows or misuse may result in restrictions on your account.

9. Medical Disclaimer

Content on the Platform (including specialties, profiles and general information) is for informational and scheduling purposes only and is not medical advice. It is not a substitute for professional diagnosis or treatment. Never disregard professional medical advice or delay seeking it because of anything on the Platform. In an emergency, contact your local emergency services immediately. We disclaim all responsibility for the medical care provided by Providers.

10. User Conduct & Prohibited Use

You agree not to: (a) provide false or misleading information; (b) impersonate any person or entity; (c) misuse, disrupt, reverse-engineer, scrape, or attempt to gain unauthorised access to the Platform or its systems; (d) upload unlawful, defamatory, obscene, infringing or harmful content; (e) use the Platform for spam, fraud, or any unlawful purpose; or (f) violate any applicable law or the rights of others. We may investigate and take action, including reporting to authorities.

11. Content, Reviews & Intellectual Property

All Platform software, design, logos, trademarks and content are owned by or licensed to the Company and protected by law. You may not copy, modify or exploit them without permission. Reviews and other content you submit must be genuine, lawful and your own; you grant us a non-exclusive, royalty-free, worldwide licence to host, display and distribute such content in connection with the Platform. We may moderate, edit or remove content at our discretion. We are not liable for User-generated content, which does not represent our views.

12. Third-Party Services

The Platform may integrate third-party services (e.g., payment gateways, maps, messaging, QR generation). Your use of them may be subject to their own terms and policies. We are not responsible for third-party services, links or content.

13. Disclaimers ("As Is")

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted/error-free operation. We do not warrant the availability, qualifications, conduct, or outcomes of any Provider, or the accuracy of any listing.

14. Limitation of Liability

To the maximum extent permitted by law, the Company, its directors, employees and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, medical negligence, misdiagnosis, or death arising from services provided by any Provider, howsoever caused.

In all cases, our total aggregate liability to you for any claim arising out of or relating to the Platform shall not exceed the total Platform Charges/Booking Fees actually paid by you to the Company in the three (3) months preceding the event giving rise to the claim, or ₹1,000, whichever is lower. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend and hold harmless the Company and its affiliates, officers, directors and employees from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your breach of these Terms or any law; (c) your infringement of any third-party right; or (d) for Providers, the services you provide and any dispute with a Patient.

16. Suspension & Termination

We may suspend or terminate your access at any time, with or without notice, for any breach of these Terms, suspected fraud or misuse, legal requirement, or to protect the Platform or its Users. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive (including disclaimers, liability limits, indemnity, IP and governing law) shall survive.

17. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics/pandemics, power or internet failures, government actions, strikes, or third-party service failures.

18. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the dispute-resolution clause below, the courts at Silchar, District Cachar, Assam shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform.

19. Dispute Resolution

In the event of any dispute, the parties shall first attempt to resolve it amicably by written notice to the Grievance contact below. If unresolved within thirty (30) days, the dispute shall be referred to arbitration by a sole arbitrator appointed by the Company under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Silchar, Assam, and the proceedings shall be conducted in English.

20. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by posting the revised Terms on the Platform with a new "Last updated" date. Your continued use after such changes constitutes acceptance. Please review this page periodically.
